WISPA files ex parte letter with the FCC
WISP File an ex parte letter with the FCC summarizing the association's positions on various net neutrality issues relevant to WISPs, small broadband providers and your customers. The letter discusses deficiencies in the FCC's Initial Regulatory Flexibility Analysis and describes why small ISPs should not be burdened with the additional coats of new transparency and reporting rules, whether under Title II or otherwise. The letter reminds the FCC that "unique network management practices" apply to WISPs that use unlicensed spectrum. In the last section, the letter addresses the legal infirmities of reclassifying broadband under Title II, but says that if the FCC reclassifies, it should (1) not forbear from pole attachment rights, and (2) not require small ISPs to contribute to USF.
